The Vietnam National United Front which was led and established by the Communist Party of Vietnam and President Ho Chi Minh, was founded on November 18,1930.

Through various stages of operating under different names, the Front has constantly raised the spirit of patriotism, the tradition of Vietnam national unity which is a decisive factor for success in the cause for national independence, unity, construction and defence of the country.

Continuing the historical role of The Vietnam National United Front, the present Vietnam Fatherland Front is a political alliance organization, a voluntary federation of the political organizations, social-political organizations, social organizations, and oustanding individuals representating various social classes and strata, ethnic groups, religions and overseas Vietnamese. The Vietnam Fatherland Front, a venue whereby to advocate the bringing into play the patriotic tradition, national pride, the sense of self-reliance, unity of all Vietnamese at home and abroad, irrespective to their social standing and nationality, their past and ideology, their religion and belief, provided that who approve the cause of renewal in order to strengthen the national independence, unity, sovereignty and territorial integrity, and soon strive for the eradication of poverty and backwardness , going forward to be a prosperous people, a strong country and a just and civilized society for the realization of President Ho Chi Minh's Testament :

" To build a country of Vietnam which is peaceful, unified, independent, democratic and rich enough".

Thus contributing positively to the cause of peace, national independence, democracy and social progress in the world.

The Vietnam Fatherland Front's standing, its role and task were defined in Article 1, and Article 2 of the Law of the Vietnam Fatherland Front :

" The Vietnam Fatherland Front is a part of the political system of the Socialist Republic of Vietnam under the leadership of the Communist Party of Vietnam, a venue whereby to be a political basis of the people's Administration, whereby to reflect the people's will, aspirations, to gather the block of the great national unity , to bring into play the people's right to be their own master, whereby to have consultation, coordination and unity of action of its member organizations. The task of the Vietnam Fatherland Front is to gather and build the block of the great national unity, to strengthen the unanimity of the spirit and the politics among people; to propagandize and encourage the people to bring into play their right to be their own masters, to realize the lines and advocacy and policies of the Party, strictly to execute the Constitution and Laws, to supervise the activities of the State bodies, elected deputies and State officers and functionaries; to collect people's opinions and their recommendations, to reflect and propose to the Party and the State; to participate in the building and enforcement of the people's Administration; together with the State to take care of and protect the people's legitimate interests; to take part in the development of relationship, co-operation between the Vietnamese and people in the regions and in the world".

Chapter I

Members of The Vietnam Fatherland front

 Article1:

Members of the Vietnam Fatherland Front at all echelons include the political organizations, social-political organizations, social organizations, and outstanding individuals representating various social classes and strata, ethnic groups, religions and oversea Vietnamese.

Membership of the Vietnam Fatherland Front shall be voluntary, unanimity to whom acquire the agreement of the Statute of the Vietnam Fatherland Front, and have been accepted and approved made by the Committee of the Vietnam Fatherland Front at the same echelon.

Article 2 : Task of the members:

The tasks of the member shall include:

1/ Realise the Statute and Program of the Vietnam Fatherland Front, collect and reflect the people's opinions and their recommendations and making report on the results of its implementation of the action united program to the Committee of the Vietnam Fatherland Front at the same echelon.

2/ Persuade and stimulate the population in execution of the Constitution and laws and implementation of the Vietnam Fatherland Front's Program.

3/ Encourage member - organizations for a correct implementation of the policy of great national unity and participation in the Front's work at their local areas.

4/ Unite, co-operate and assist organizations and individuals who have not yet joined the Front but wish to support the Vietnam Fatherland Front's Program.

Article 3 : Member's right

The right of members shall include :

1/ Discuss, request, criticise and make proposal on the organization and activities of the Committee of the Fatherland Front.

2/ Request the Committee of the Fatherland Front of the same echelon to hold consultative meetings in order to co-ordinate its activities with concerned member organizations to aim at responding to its initiative on mobilizing people to realize the Vietnam Fatherland Front?;s Program.

3/ Participate in making the State policies and laws.

4/ Request the Committee of the Vietnam Fatherland Front to protect its legitimate interest

5/ Get informations on its activities issued by the Committee of the Fatherland Front of the same echelon.

6/ Nominate candidates to the consultations for the election of the Committee of the Fatherland Front of all echelons.

Article 4 : Relationship among members

The relationship among members in the Vietnam Fatherland Front is based on equal cooperation, sincere solidarity, mutual respect in order to implement the tasks of the State's politics, economy, culture, society, defense security, external affairs and of the Vietnam Fatherland Front's Programs.

 chapter II

organization and activities of

the Vietnam Fatherland Front

 Article 5 : The principle of the organization and its activities

The Vietnam Fatherland Front's organizations and its activities shall be based on voluntary, democratic consultation, co-ordination and unity of action.

In co-ordination and unity of action, the members of the Vietnam Fatherland Front shall execute the Statute of the Vietnam Fatherland Front; at the same time the independence of their organization shall still be maintained.

Article 6 : System of the organization

The Vietnam Fatherland Front shall be organized on the administrative echelons at:

  • The Central echelon

  • Provinces and cities directly under the central echelon

(hereinafter refer to as "Provinces" )

  • Districts, towns and small cities directly under the province echelon

(hereinafter refer to as " Districts")

  • Communes, wards and district towns

(hereinafter refer to as " Communes")

There is a Committee of the Vietnam Fatherland Front at each echelon.

Under the commune echelon, there is a Mission of the Front working in the residential communities.

Article 7 : Congress

1/ The Congress of Representatives (CoR) of the Fatherland Front at each echelon shall be the highest consultative organ of the Fatherland Front at that echelon, and shall be held once every 5 years.

2/ The composition, number of delegates to the CoR of the Vietnam Fatherland Front shall be agreed upon by consultation by the conference of the Central Committee of the Vietnam Fatherland Front. The National Congress of the Vietnam Fatherland Front has the following functions to:

a/ Discuss and adopte the report in term of the Central Committee of the Vietnam Fatherland Front;

b/ Approve the program of united action of the Vietnam Fatherland Front in its new tenure;

c/ Amend, supplement the Statute of the Vietnam Fatherland Front;

d/ Hold the democratic consultative meetings to select the Central Committee of the Vietnam Fatherland Front.

3/ The composition and number of delegates to the Congress of the Fatherland Front at local echelons shall be agreed upon by the conference of the Committee of the Fatherland Front at its echelon under the guidance of the Committee of the Fatherland Front at immediate higher echelon. The Congress of the Fatherland Front at each echelon, shall be held by the Committee of Fatherland Front at its echelon which has the function to:

a/ Discuss and approve the report in term of the Committee of the Fatherland Front at its echelon.

b/ Adopt the program of united action of the Fatherland Front at its echelon in its new tenure;

c/ Change, compliment Articles of Association of the Fatherland Front at the immediate higher echelon ( if necessary);

d/ Conduct the democratic consultative meetings to select the Committee of the Fatherland Front at its echelon.

Article 8 : The Committee of Vietnam fatherland Front

1/ The Committee of the Vietnam Fatherland Front at each echelon shall be an executive body between two tenures of the Congresses of the Vietnam Fatherland Front at the same echelon.

2/ The Committee of the Vietnam Fatherland Front at each echelon shall acquire the responsibility for the organization and realization of the Vietnam Fatherland Front's Program made by the Congress at the same echelon and the tasks of the Vietnam Fatherland Front.

3/ The number of members of the Committee of the Fatherland Front at each echelon shall be agreed upon by the Congress of the Fatherland Front at that echelon according to the composition defined in Article 9 of this Statute and the guidance of the Committee of the Fatherland Front of the immediate higher echelon.

4/ A member is naturally no more a member of the Committee of the Fatherland Front at each echelon in the following cases :

    • No more a representative of member organization at its echelon;

    • No more a representative of the Committee of the Fatherland Front at the lower echelon

    • A cadre who retired or adopted other work.

The replacement of him/her shall be decided by the Committee of the Fatherland Front at his/her echelon.

During the tenure of Congress, if it is necessary to enlarge the Fatherland Front, the Committee of the Fatherland Front at each echelon shall have the right to supplement some members but this supplementation must not be exceeded one third of total membership of the Committee of the Fatherland Front appointed by the Congress.

Article 9: Composition of the Committee of the Vietnam Fatherland Front at all echelons :

1/ The composition of the Committee of the Vietnam Fatherland Front at central, provincial, district echelons includes :

a/ The Head of the member organization;

b/ President of the Committee of Fatherland Front at the immediate lower echelon;

c/ Some of the representative individuals of all classes, social strata, nationalities, religions and overseas Vietnamese;

d/ Some of the special cadres and responsible for the Fatherland Front's work and its activities;

e/ Some of the specialists in the fields associated to the Fatherland Front's activities;

2/ The composition of the Committee of the Fatherland Front at the commune/ hamlets echelon includes:

a/ The Head of the member organization of the same echelon;

b/ Some of the Leaders of the Committees of the Front's work;

c/ Some of the representative individuals of all classes, social strata, ethnic groups, religions and overseas Vietnamese;

3/ The regular meeting of the Central Committee of the Fatherland Front shall be convened at least once a year. The regular meeting of the Committee of the Fatherland Front at the provincial, district echelon shall be convened at least once every six months. The regular meeting of the Committee of the Fatherland Front at commune and equivalent echelon, shall be convened at least once every three months.

4/ The regular Congress of the Committee of the Fatherland Front at all echelons shall have its tasks to:

a/ Discuss the situation and the results from the coordination of implementing the recent program of action, and to decide the coming program of action of the Vietnam Fatherland Front;

b/ Contribute its ideas and suggestions in the Congress?;s documents of the Fatherland Front at the same echelon or at the higher echelon ( if necessary);

c/ Hold consultative meetings with Committees about its organization and membership based on to the authority of each Committee of the Fatherland Front( if necessary)

d/ Discuss and decide other issues based on the authority

of the Committee of the Fatherland Front and as submitted by its by its Permanent Bureau.

Article 10 : The Presidium of the Central Committee of the Vietnam Fatherland Front

1/ By democratic consultation, the members of the Presidium of the Central Committee of the Vietnam Fatherland Front are selected among the members of the Central Committee of the Fatherland Front.

2/ The Presidium who shall be the representative of the Central Committee of the Vietnam Fatherland Front between its two meetings, shall have the following tasks and obligations to :

a/ Make decision on policy, activities so as to realize the program of actions and resolutions of the Central Committee of the Vietnam Fatherland Front submitted by its Permanent Bureau;

b/ Make suggestions, recommendations which is on the direction, lines of policy, to submit to the Party and State. Make its suggestions, recommendations on policies and laws to the State;

c/ Review, decide to assign and/o relinquish members of the Permanent Bureau, and shall be based on proposal of its Permanent Bureau and make report to the Central Committee of the Fatherland Front at the coming meeting.

3/ The regular meeting of the Presidium of the Central Committee shall be convened at least once every 6 months.

Article 11: The Permanent Bureau of the Central Committee of the Vietnam Fatherland Front

1/ The members of the Permanent Bureau of the Central Committee of the Vietnam Fatherland Front with its members are selected among members of the Presidium, the Central Committee of the Vietnam Fatherland Front through the democratic consultation will appoint : President, General Secretary and the Permanent Bureau members. The Permanent Bureau consists of memebers who carry out day by day tasks/ responsibilies.

2/ The Permanent Bureau of the Central Committee who consists of representatives of the Central Committee and the Presidium between the two consultative meetings of the Congress, shall have its tasks and obligations to :

a/ Make preparation for the sessions of the Presidium and assist the Presidium to prepare the sessions of the Central Committee of the Fatherland Front;

b/ Organize to realize the program of actions of the Central Committee, the determinations of the Presidium; in line with the Party's direction and policy, the State's laws all of which are associated to the tasks, obligations of the Committee of the Vietnam Fatherland Front;

c/ Give guidance, supervision to the activities of the Permanent Bureau of the Committee of Fatherland Front at provincial echelon;

d/ Review, adopti appointment, replacement of President, Vice- President, Permanent Bureau members of the Committee of Fatherland Front at provincial echelon;

e/ Organize, manage the assisted apparatus in the Central Committee of the Vietnam Fatherland Front;

f/ Improve the relationship and the co-ordination with the State's bodies and member organizations;

g/ Guiding and creating favorable conditions for organizations to give consulting, advising activities to the Central Committee of the Vietnam Fatherland Front.

3/ The regular meeting of the Permanent Bureau of Central Committee of the Vietnam Fatherland Front shall be convened at least once every month.

Article 12 :The Permanent Bureau of the Committee of the Fatherland Front at local echelons

1/ The member of the Permanent Bureaus of the Committee of the Fatherland Front at provincial and district echelons are selected among the members of the Committee of the Fatherland Front at the same echelons through democratic consultations including: Chairpersons, Vice-Chairpersons, Permanent Bureau members. The Permanent Bureau consists of designated responsibility officials.

The members of the Permanent Bureau of the Committee of the Fatherland Front at hamlets/villages echelon are selected among members of the Committee of the fatherland Front at hamlets/ villages echelon through democratic consultation including Chairpersons, Vice-Chairpersons and Permanent Bureau members.

2/ The Permanent Bureau at each local echelon is the representative of the Committee of the Fatherland Front at this echelon between two meetings of the Congress, and shall have its tasks and obligations to :

a/ Make preparation for the meeting of the Committee of the Fatherland Front;

b/ Realise / implement the program of actions of the Committee of the Fatherland Front at its echelon and the program of action of the higher echelon; advocate the policy of the Party, the State's laws; the resolutions of the people's Council, the decisions of the people's Committee, which are associated to the tasks, obligations of the Committee of the Vietnam Fatherland Front;

c/ Guiding, supervising the activities of the Permanent Bureau of the Committee of the Fatherland Front at the immediate lower echelon;

d/ Review, approve of appointment, replacement of Chairperson, Vice- Chairperson, Permanent Bureau members of the Committee of Fatherland Front at the immediate lower echelon;

e/ Organise, manage and operate the administrative apparatus of the Committee of the Fatherland Front at its echelon;

f/ Liaise and coordinate activities with with the State's bodies and member organizations;

g/ Make guidance and create favorable conditions for the activities of the advisory organizations, collaborators of the Committee of the Fatherland Front at its echelon.

With regard to the Permanent Bureau of the Committee of the Fatherland Front at commune, its task, obligation at clauses c, d , f of this Article shall not be executed

3/ The regular meeting of the Permanent Bureau of the Committee of the Fatherland Front at local echelons shal be convened at least twice every month.

Article 13: Appointment of office holders of the Committee of the Vietnam Fatherland Front

The appoitment of the officers of the Committee of the Vietnam Fatherland Front at all echelons shall be based on clause 1 Article 11, clause 1 Article 12 of this Statute. In the case of absence of unanimity, the appoitment shall be made by secret vote; the elected person must receive the approval of more than half of the membership of the Committee of the Fatherland Front at the echelon.

Article 14: Working regulations of the Permanent Bureau

The working regulations of the Permanent Bureau of the Committee of the Fatherland Front at all echelons shall be based on collective discussion, determination, assignment for individual accountability.

Article 15: Organization and cadres of the Committee of the Fatherland Front

1/ On the basis of the function, task, obligation of the Vietnam Fatherland Front which is defined in the Law of the Vietnam Fatherland Front, in the associated legislation, and after having unanimity with authorized institutions, The Central Committee of the Vietnam Fatherland Front shall have its regulation to the organization and cadre in the office of the Central Committee of the Vietnam Fatherland Front, in the offices the Committee of the Fatherland Front at provincial and district echelons; the organizations and personel of the Permanent Bureau of the Committee of the Fatherland Front at village/hamlet echelons.

2/ The Central Committee of the Vietnam Fatherland Front shall have its responsibility to foster, improve the capabilities and integrity of the specialised and responsible cadres of the Central Committee of Vietnam Fatherland Front and the Committee of the Fatherland Front at provincial echelon.

The Committee of the Fatherland Front at provincial echelon shall have the responsibility to organize and improve the capabilities and integrity of the specialised and responsible cadres of the Committee of the Fatherland Front at its echelon and at district echelon.

The Committee of the Fatherland Front at district echelon shall have its responsibility to organize, improve the capabilities and integrity of the specialised and responsible cadres of the Committee of the Fatherland Front at its echelon, members of the Permanent Bureau of the Committee of the Fatherland Front at commune echelon and the Mission of the Front's work.

3/ When the replacement of the President, Vice-President, members of the Permanent Bureau of the Committee of the Fatherland Front at provincial, and district echelon take place, the Permanent Bureau at its echelon should make the report to the Permanent Bureau of the Committee of the Fatherland Front at immediate higher echelon. The appointment, supplementation, acceptance of that office shall be carried out in accordance with paragraph 1 Article 11 and paragraph 1 Article 12 of this Statute.

Article 16: Committee of actions (CoA) of the Front's work

1/ The CoA of the Front's work is organized at villages, wards, hamlets, districts, other local communities, by the decision of establishment of the Committee of the Fatherland Front at village, wards, township.

2/ The CoA of the Front acquire the function of coordination and unity of actions among the members; of coordination with the Head of villages so as to realize the tasks :

    • To directly mobilize the population in carrying out the Party's direction, policy, the State's laws; the resolution of the people's Council, the decision of the people's Committee and the program of actions of the Fatherland Front at all echelons;

    • To encourage the population to participate in the supervision of the activities of the State's institutes, elected deputies, State?;s cadres and functionaries;

    • To coordinate the implementation of the democratic regulations and the people's self - management of their activities at the local communities.

Article 17: Advisory Organization, collaborators

1/ The Committee of the Fatherland Front at all echelons could set up its advisory organizations, enlarge the network of collaborators at its echelons, assist the Committee of the Fatherland Front to realize its functions, tasks, obligations.

2/ The advisory organization is non-specialized, and includes : the members of the Committee of the Fatherland Front and experts in some fields associated to the activities of the Fatherland Front.

3/ The Permanent Bureau of the Committee of the Fatherland Front at each echelon has guidance to create favourable conditions to the activities of the advisory organization and collaborators at its echelon.

Chapter IiI

The relationship among the committee of the Fatherland Front at all echelons,

the relationship between the committee of the Fatherland front and state's bodies, and the population

 

Article 18 : Relationship among the Committee of the Fatherland Front at all echelons

1/ The relationship between the Committee of the Vietnam Fatherland Front at higher echelon and the Committee of the Vietnam Fatherland Front at lower echelon is a guidance and supervision relationship.

2/ The Committee of the Fatherland Front at lower echelon executes the policy, the program of action of the Committee of the Vietnam Fatherland Front at higher echelon; implement the regulation concerning reporting to the Committee of the Vietnam Fatherland Front at higher echelon; make its recommendation to the Committee of the Fatherland Front at higher echelon on the issues associated to the activities of the Fatherland Front.

3/ The Committee of the Fatherland Front at all echelons exchange their experiences, cooperation and assist one another in their activities.

Article 19: Relationship between the Committee of the Vietnam Fatherland Front and State's

Institutions

1/ The relationship between the Committee of the Vietnam Fatherland Front and State's institutions is on the basis of coordination so as to realize the tasks and the obligations regulated in the Constitution and laws.

2/ The relationship between the Committee of the Vietnam Fatherland Front and State's institutions is on the basis of coordinating activities issued by the Committee of the Fatherland Front and related State's institutions at each echelon.

Article 20: Relationship between the Committee of the Fatherland Front and Population

In the relationship with the population, the Committee of the Vietnam Fatherland Front, members of the Fatherland Front at all echelons mobilize the population to bring into play their right to be their own masters, carry out the Party's lines, direction, policies, execute strictly the Constitution and laws, supervise the activities of the State?;s institutions, elected deputies and State's cadres and functionaries; collect opinion and recommendations to reflect to the Party and the State; take care of and protect the people's legitimate interests.

 

Chapter IV

Award - punishment

 

Article 21: Award

Any individual or organization who make excellent achievements in the cause of Great National Unity would be commended.

The highest distinction awarded by the Central Committee of the Vietnam Fatherland Front is the medal " For the Cause of Great National Unity".

Article 22 : Punishment

Any member who acts counter to the regulations of this Statute of the Vietnam Fatherland Front shall, depending on his/her offence, be blamed, served warning or be expelled from the member of the Vietnam Fatherland Front.

 

Chapter V

Financial resource, property of the committee of the Fatherland Front

 

Article 23: Financial resource

The financial resource of the Committee of the Fatherland Front at all echelons includes:

    • Budget allocated by the State;

    • Financial resources gained from participation in the implementation of programs and projects;

    • Incomes obtained by the lawful business operations;

    • Aid from organization and individuals at home and abroad;

Article 24: Property

The property of the Committee of the Fatherland Front at all echelons includes:

a/ Property assigned by the State;

b/ Property donated by organization and individuals at home and abroad;

The acceptance, management, utilization of those property shall be based on rules and regulation of the laws.

 

Chapter Vi

Implementation provisions

 

Article 25: Implementation

This Statute shall be of full force and effect as of the date of the approval of the Vth Congress of the Vietnam Fatherland Front.

All previous provisions which are inconsistent with this Statute are hereby repealed.

 

Article 26: Amendment of the Statute

The amendment of the Statute shall only be implemented by the Congress of the Vietnam Fatherland Front.

Article 27: Implementation entrustment

The implementation emtrustment of this Statute shall be entitled by the Permanent Bureau of the Central Committee of the Vietnam Fatherland Front.

This Statute was passed by the Vth Congress of the Vietnam Fatherland Front in Hanoi from 26-28/8/1999.
